Definitions
- "Proto Studio": Refers to the Platform as a Service (PaaS) and any associated services, tools, or platforms provided by the company.
- "User": Any individual, entity, or organization that accesses or uses Proto Studio's services.
- "Customer": A user who has entered into a service agreement with Proto Studio to utilize the platform for developing, deploying, or managing digital projects, including but not limited to applications, databases, and websites.
- "User-Generated Content (UGC)": Any content created, uploaded, posted, or otherwise made available on Proto Studio by users or by the users of any projects, applications, or systems deployed by customers on the platform. This includes text, images, videos, software, and other materials.
- "AUP" (Acceptable Use Policy): This document, which outlines the rules and responsibilities for users of Proto Studio to ensure the platform is used lawfully and respectfully.
- "Compliance": Adherence to the AUP, as well as any applicable local, state, national, and international laws and regulations.
- "Moderation": The process of reviewing and managing user-generated content to ensure compliance with the AUP and any applicable laws or regulations.
Introduction
This Acceptable Use Policy provides the framework for responsible and lawful use of Proto Studio’s services, aiming to ensure a secure, respectful, and free-speech-oriented environment for all users.
User Responsibilities
- Data Permission and Security: Users must secure the necessary permissions for the data they handle and ensure its protection, including correct access controls setup. Proto Studio is not responsible for breaches resulting from user misconfiguration.
- Content Moderation and Compliance: Customers are responsible for ensuring that user-generated content on projects deployed to the Proto Studio platform is moderated to comply with this AUP. Recognizing the importance of free speech and the technical challenges inherent in moderating user-generated content, Proto Studio will intervene only in cases where violations are repeated and flagrant, or actively encouraged by the user, its employees, or associates.
- API Key Security: The security of API keys is the customer’s responsibility. Proto Studio is not liable for unauthorized use due to insufficient security.
Prohibited Content and Legal Compliance
Users of Proto Studio must not engage in or facilitate:
- Activities that are illegal under the laws of the United States, New Hampshire, and Delaware, and/or the user’s jurisdiction.
- The endangerment or exploitation of minors.
- The distribution of malware, viruses, or malicious software.
- Hate speech, harassment, threats, slander, self-harm, or similar harmful conduct.
- Intellectual property rights infringement.
- Fraudulent activities, including phishing.
- The use of tools for security exploitation or denial of service attacks (e.g., DDoS).
- The sending of unwanted emails (SPAM), text messages, or making unsolicited phone calls.
- Irresponsible use of AI. See the next section.
- Identifying or monitoring individuals without their concent.
- Multi-level marketing.
- Online gambling or sports betting.
Due to their potential for abuse or additional compliance requirements, users must not engage in or facility the following except with the express written permission of Proto Studio:
- Banking, insurance, investment, or financial services.
- Legal or law related services.
- The use of blockchain technology.
- Medical or health services.
- The sale of pharmaceuticals, medicine, or otherwise controlled or regulated products or substances.
- Web crawling.
This list is illustrative and not exhaustive; activities presenting similar risks or harms are also prohibited. If you have any questions as to whether something is compliant, please contact us prior to publishing your project.
In addition to the requirements of this AUP, users are responsible for ensuring their use of Proto Studio complies with all applicable local, state, national, and international laws and regulations, including any relevant industry-specific compliance standards and certifications. Users must conduct their operations on Proto Studio in a manner that adheres to their local regulations and any industry-specific guidelines or certifications relevant to their projects.
Responsible Use of Artificial Intelligence (AI)
Proto Studio is committed to promoting ethical and responsible use of AI technologies. When using Proto Studio software and/or systems (including but not limited to API, website, compute resources, and storage) users must adhere to the following guidelines to ensure AI is utilized in a manner that is lawful, ethical, and respectful of individual rights:
- Impersonation: Using AI to impersonate another individual without their explicit consent is strictly prohibited. This includes but is not limited to creating digital voices, images, or videos that mimic another person.
- Image and Video Editing: Creating or editing images, videos, or any digital content depicting individuals without their consent is prohibited. Special care must be taken to respect individuals' rights and privacy.
- Decision-Making Processes: AI should not be used to make life-altering decisions regarding lending, investments, medical, insurance, housing, criminal justice, employment, education, or similar without human oversight. It is essential that such decisions include a "human in the loop" to review AI recommendations, ensuring fairness, accountability, and transparency.
- Misinformation and Deception: Using AI to generate content intended to deceive or manipulate is forbidden. This includes generating content that could mislead individuals into believing it was created by a human when it was actually produced by AI. AI content should be reviwed by a human editor and/or labeled as AI created.
These guidelines are designed to ensure that AI technologies are used in a way that upholds human dignity and rights, and to prevent harm that could arise from misuse. Users are responsible for the ethical deployment of AI within their projects on Proto Studio, including adherence to any additional local or international regulations governing AI use.
Note: Users should remain informed about evolving ethical standards and legal requirements related to AI and ensure their projects on Proto Studio are updated accordingly to maintain compliance.
Responsible API Use
Customers are expected to:
- Use Proto Studio’s API in a way that does not negatively impact the platform or other users.
- Adhere to the documented rate limits.
- Avoid automating actions that are intended for manual execution.
- Ensure their use does not disrupt platform stability or performance.
AUP Modifications
Proto Studio reserves the right to update this policy periodically. Users should review the AUP on https://proto.studio/legal/aup/ regularly. Continued use of the service post-update signifies acceptance of the revised terms.
By using Proto Studio, users agree to follow this Acceptable Use Policy, supporting a secure, lawful, and respectful environment for all participants, while upholding the principles of free speech.
